BLOUNTVILLE — A father and son are accused of assaulting a man outside the Blountville home of the father’s estranged wife.
A Sullivan County grand jury on Tuesday indicted Tommy M. Boswell Jr., 19, 543 Muddy Creek Road, Blountville, and Tommy Michael Boswell Sr., 43, 3814 Memorial Blvd., Apt. 20, Kingsport, on one count each of aggravated assault, stemming from their alleged use of a pickup truck and wooden club to assault a man outside the 543 Muddy Creek Road residence.
According to court records, the alleged victim, identified as Brandon Yates, told police he was asleep on a couch in the residence on Feb. 12 when someone started beating on the door between 10 and 11 a.m.
Yates told police Boswell Jr., aka “Mike,” entered the residence wielding a wooden club, making threats and ordering him to leave.
Yates said he left and was walking down the driveway toward Muddy Creek Road when he noticed a gray Chevrolet pickup truck with “Tommy’s Paving” on the side headed straight for him.
Yates told police he turned and ran toward a fence in the yard but couldn’t outrun the truck. He said he jumped on the front of it, flipped over the hood and landed on the driveway.
Yates said he managed to get up and run, but both Boswells and an unidentified white male caught up with him. He alleged Boswell Jr. struck him “on the head, back and arms” with the wooden club, and that all three suspects were “kicking and punching” him while he was on the ground.
Yates advised he eventually managed to take the club away from Boswell Jr. and flee to a neighboring residence. The neighbor took Yates to a Shell gas station on Airport Parkway, where EMS picked him up and transported him to Holston Valley Medical Center for treatment of his injuries, which included “possible broken bones.”
Police responded to the Muddy Creek Road residence and spoke with the resident, Angel Boswell. She advised that she and Tommy Boswell Sr. had been separated since October 2011. That morning, Angel Boswell said she heard her estranged husband’s truck in the driveway and heard him “yelling and cursing” her, then someone began beating on the door and she heard the glass shatter.
Angel Boswell told police she heard someone yelling about hurting someone, and by the time she got outside she saw Boswell Jr.’s black Ford leaving the driveway.
Police spoke to Boswell Sr. via a phone call, with the elder Boswell allegedly stating “the three of us did work him over” before hanging up the phone.
Others indicted Tuesday and their charges include:
• Tonya Hicks, 28, 11008 Stanley Valley Road, Gate City, Va., possession of Schedule II controlled substance.
• Tabitha Drake, 21, 504 Alcoa Drive, Kingsport, burglary, theft over $500, assault (two counts).
• Joshua Eugene Holmes, 20, 504 Alcoa Drive, Kingsport, burglary, theft over $500.
• Kimberly Elizabeth Olterman, 21, 3327 Horseshoe Drive, Kingsport, theft over $1,000.
• James B. Booher, 41, 108 Maplehurst Lane, Bluff City, aggravated burglary, theft over $500.
• Travis G. Goins, 40, 1017 W. Stone Drive, Kingsport, violation of habitual traffic offender order, DUI, possession of marijuana, felony failure to appear.
• Alex W. Gibson, 26, 1641 C St., Kingsport, identity theft, possession of drug paraphernalia, public intoxication.
• Miranda Noel Cox, 26, 1198 Summerville Road, Kingsport, theft $500 or less, theft $1,000 or more.
• Gabriel Wayne Cross, 25, 721 Walnut Hill Road, Bristol, Tenn., domestic assault, vandalism $500 or less.
• James E. Ball, 50, 420 Hood Road West, Kingsport, theft over $1,000.
